Abstract

This article aims to comment on the decision issued in the context of the Special Appeal No. 2,130,619/SP, judged by the Brazilian Superior Court of Justice, which dismissed civil liability for the leakage of personal data. The rationale behind this decision is that the leakage of natural persons' data by a legal entity, by itself, does not generate presumed moral damage. When discussing the decision, the text reflects on the prerequisites outlined by Justice Francisco Falcão, the rapporteur of the judgment, in light the doctrine of the right to personal data protection, also considering the convergence of the specific rules on the protection of personal data with the rules on consumer protection with regard to civil liability.

Este artigo tem como objetivo comentar a decisão proferida no âmbito do Agravo em Recurso Especial n. 2.130.619/SP, julgado pelo Superior Tribunal de Justiça, que afastou a responsabilidade civil por vazamento de dados pessoais, sob o fundamento de que vazamento de dados de pessoa natural por pessoa jurídica, por si só, não gera dano moral presumido. Ao comentar a decisão, o texto reflete acerca dos pressupostos elencados pelo Ministro Francisco Falcão, relator do acórdão, à luz da dogmática do direito fundamental à proteção de dados pessoais, considerando também a convergência das normas específicas da proteção de dados pessoais com as normas de proteção dos consumidor no tocante à responsabilidade civil.
