
In Brazilian law, compensatio lucri cum damno is still a relatively unknown concept. Numerous cases in Brazilian case law employ compensatio lucri cum damno reasoning. Nonetheless, the legal concept is not specifically mentioned in the rulings. Divergent views have been formed by the Superior Court of Justice with respect to compensation of profits with damages. In REsp 1.309.978/RJ, the Superior Court of Justice did not allow amounts received as social security benefits to be deducted from damages awarded. But, in REsp 1.191.598/DF, it adopted the opposite rationale as to mandatory insurance (DPVAT), even in the absence of receipt or request for the amount. We conclude that Comparative Private Law could assist Brazilian courts in establishing more rational and effective standards for compensatio lucri cum damno.
A compensatio lucri cum damno é tema pouco discutido no Direito brasileiro. Na jurisprudência brasileira, abundam casos que se valem da lógica da compensatio lucri cum damno. Entretanto, os julgamentos não mencionam expressamente o instituto. O Superior Tribunal de Justiça (STJ) fixou entendimentos distintos acerca da possibilidade de compensar-se lucro com dano. São exemplos: (i) o REsp nº 1.309.978-RJ, que não admitiu a compensação de valores percebidos a título de benefícios previdenciários; e (ii) o EREsp nº 1.191.598/DF, que permitiu a compensação de valores do seguro obrigatório DPVAT mesmo quando ausentes recebimento ou requerimento do seguro. Neste texto, conclui-se que o Direito Civil Comparado pode auxiliar a jurisprudência brasileira a fixar critérios e parâmetros para a compensatio lucri cum damno.
