El principio de calificación jurídica y sus límites en el ámbito tributario al amparo de la jurisprudencia del Tribunal de Justicia de la Unión Europea

Abstract

El principio de calificación se configura como una facultad de la Administración ex lege que le permite determinar la existencia del verdadero hecho imponible y su concreción, con independencia de la forma o la denominación que las partes le hubieran dado. Dado que la calificación consiste en una operación esencialmente interpretativa, configurada como una institución claramente antielusiva, no debemos olvidar que la influencia del Derecho de la Unión Europea en este ámbito constituye, precisamente, la delimitación de este tipo de normas, por lo que la calificación se vislumbra como una potestad sometida, entre otros, a los principios de la hermenéutica jurídica y que, además, viene condicionada por una serie de límites que impiden, precisamente, su uso abusivo.
