Abstract

RESUMEN Este trabajo examina la Directiva (UE) 2021/1883, que regula la Tarjeta Azul de la Unión Europea, desde una perspectiva iusprivatista centrada en el estatuto personal de los nacionales de terceros Estados altamente cualificados. La reforma persigue fortalecer la capacidad de la UE para atraer y retener talento global mediante una flexibilización sustancial de los requisitos de admisión, la reducción del umbral salarial, la ampliación de los periodos de validez del permiso y desempleo admisible, así como la creación de procedimientos abreviados para empleadores reconocidos. Se analizan además las mejoras en movilidad intracomunitaria y el impacto de la nueva regulación sobre la reunificación familiar, particularmente a través de la interacción con la Directiva 2003/86/CE y las Directrices de 2014 de la Comisión. Se concluye que, aunque la Directiva avanza hacia un estatuto más protector y funcional para atraer talento, persisten márgenes discrecionales estatales que pueden limitar la eficacia del derecho a la vida familiar y la convergencia real de los regímenes jurídicos nacionales. ABSTRACT This paper analyses Directive (EU) 2021/1883 on the EU Blue Card from a private international law perspective, focusing on the personal status and rights granted to highly skilled third‑country nationals. The recast aims to enhance the EU’s competitiveness in the global race for talent by easing admission conditions, lowering salary thresholds, extending the validity of permits and allowable unemployment periods, and introducing accelerated procedures for recognised employers. The study also examines the strengthened rules on intra‑EU mobility and the improved framework for family reunification, in light of Directive 2003/86/EC and the Commission’s 2014 Guidelines. The conclusion highlights that, while the reform significantly expands legal certainty and rights for beneficiaries, the broad discretion retained by Member States may still hinder effective family life and the harmonisation of national migration regimes.
