Abstract

Cet article analyse la singularité de l’Émir Abdelkader (1808–1883) comme figure normative majeure dans l’histoire universelle de la paix et du droit humanitaire. Loin de se réduire à un chef de résistance anticoloniale ou à un maître spirituel soufi, l’Émir apparaît ici comme un praticien rigoureux du droit de la guerre (jus in bello) avant sa codification moderne. À partir de ses règlements militaires, de sa gestion des prisonniers de guerre et de son intervention décisive en faveur des populations chrétiennes de Damas en 1860, l’étude met en lumière une conception intégrée du droit comme expression de la justice divine, indissociable de l’éthique, de la métaphysique et de la responsabilité politique. L’article propose une lecture comparée entre les pratiques abdelkaderiennes et les normes contemporaines du droit international, notamment les Conventions de Genève, la Déclaration universelle des droits de l’homme, la doctrine de la Responsabilité de protéger et le cadre onusien Faith for Rights. Il montre que l’héritage de l’Émir constitue une matrice théorique encore largement inexploitée pour penser une paix conçue non comme simple suspension de la violence, mais comme exigence ontologique, juridique et spirituelle engageant simultanément l’individu, la communauté et l’ordre international.
