
El ensayo examina la aplicación del principio de proporcionalidad y la dignidad humana frente a normativas injustas, destacando la primacía de los derechos fundamentales sobre reglas formales. A partir de la ponderación de principios y el análisis de un caso del Tribunal Europeo de Derechos Humanos sobre vigilancia laboral, se sostiene que las normas internas no pueden vulnerar la vida privada ni la dignidad de las personas trabajadoras. Se concluye que la vigilancia es válida solo si es clara, proporcional y mínimamente invasiva.
