RESPONSABILIDAD CIVIL Y SOSTENIBILIDAD AMBIENTAL EN INFRAESTRUCTURAS INTELIGENTES: SÍNTESIS CRÍTICA DESDE UNA REVISIÓN SISTEMÁTICA

Abstract

Las tecnologías energéticas inteligentes se han expandido con rapidez, generando nuevas dinámicas técnicas, jurídicas y ambientales cuya complejidad supera la capacidad regulatoria vigente, lo que convierte su análisis en una necesidad urgente para garantizar una transición energética segura y sostenible. Este estudio tuvo como objetivo evaluar las repercusiones legales y ambientales derivadas de la falta de un marco de responsabilidad civil específico en la implementación de estas tecnologías, examinando cómo la ausencia de regulación influye en los riesgos operativos, la protección de datos y los impactos ecológicos asociados. Para ello se desarrolló un artículo de revisión sistemática, basado en la identificación, selección y análisis comparado de literatura científica reciente, lo que permitió integrar evidencia técnica, jurídica y ambiental proveniente de múltiples enfoques. Los resultados indican que la falta de regulación genera incertidumbre en la imputación de daños, incrementa las vulnerabilidades tecnológicas, expone a los usuarios a riesgos derivados del manejo de datos y favorece la aparición de perjuicios ambientales vinculados a fallas no supervisadas. La conclusión más relevante sostiene que la consolidación de marcos normativos especializados constituye una condición indispensable para reducir los riesgos emergentes y asegurar que la adopción de tecnologías energéticas inteligentes se desarrolle bajo criterios de seguridad jurídica, protección ambiental y responsabilidad social
