Abstract

Este estudio analiza la tensión entre la seguridad jurídica y la extralimitación estatal en la producción normativa dentro de la Comunidad Andina, un modelo de integración supranacional. Se centra en la "norma de clausura" y el principio de complemento indispensable, mecanismos que permiten a los Estados miembros complementar el derecho comunitario, pero que generan debates sobre la autonomía estatal y la primacía del derecho comunitario. El objetivo es examinar la relación entre estos mecanismos y la seguridad jurídica, así como el papel del Tribunal de Justicia de la Comunidad Andina como garante de este principio. La metodología combina análisis dogmático de jurisprudencia, normas comunitarias y doctrina especializada en este ámbito. Los resultados muestran que el Tribunal de Justicia juega un rol crucial en asegurar que las legislaciones nacionales complementen, y no contradigan, el ordenamiento comunitario. Su autonomía le permite prevenir extralimitaciones estatales y fortalecer la predictibilidad del derecho andino. Se concluye que el Tribunal, a través de su interpretación y supervisión, es esencial para mantener la coherencia y eficacia del derecho comunitario, protegiendo así la seguridad jurídica en la región.

This study examines the tension between legal certainty and state overreach in normative production within the Andean Community, a supranational integration model. It focuses on the "closure rule" and the principle of indispensable complement, mechanisms that allow member states to supplement community law, but generate debates about state autonomy and the primacy of community law. The main objective is to examine the relationship between these mechanisms and legal certainty, as well as the role of the Andean Community Court of Justice as a guarantor of this principle. The methodology combines dogmatic analysis of jurisprudence, community norms and doctrine. The results show that the Court of Justice plays a crucial role in ensuring that national legislation complements, and does not contradict, the community legal system. Its autonomy allows it to prevent state overreach and strengthen the predictability of Andean law. It is concluded that the Court, through its interpretation and supervision, is essential to maintain the coherence and effectiveness of community law, thus protecting legal certainty in the region.
