Abstract

الملخص : يتناول هذا البحث توظيف تقنيات النانو بوصفها أداة قانونية-تقنية ناشئة يمكن أن تسهم في تعزيز كفاءة منظومة العدالة وتحقيق السرعة والدقة في الإجراءات القضائية. وينطلق البحث من تحليل العلاقة بين التطور العلمي المتسارع في مجال النانو تكنولوجي ومتطلبات العدالة الحديثة، ولا سيما في مجالات الإثبات الجنائي، وتحليل الأدلة الرقمية، ومكافحة الفساد، وحماية الأدلة من العبث أو التلف. ويعتمد البحث على المنهج التحليلي المقارن لبيان كيف يمكن لتقنيات النانو أن تُحدث تحولًا نوعيًا في وسائل الإثبات، عبر تطوير أدوات كشف دقيقة، وتقنيات تتبع غير مرئية، وأنظمة حماية متقدمة لسلاسل الحيازة القانونية للأدلة. كما يناقش الإطار القانوني الحاكم لاستخدام هذه التقنيات، والتحديات التشريعية والأخلاقية المرتبطة بها، مع تقديم رؤية استشرافية لكيفية دمج النانو تكنولوجي ضمن السياسات القضائية المعاصرة بما يحقق التوازن بين الابتكار التكنولوجي وضمانات المحاكمة العادلة. Abstract This research examines nanotechnology as an emerging legal-technical tool capable of enhancing the efficiency of justice systems by improving accuracy, speed, and reliability in judicial procedures. The study explores the intersection between rapid scientific advancements in nanotechnology and the evolving requirements of modern justice, particularly in criminal evidence analysis, digital forensics, anti-corruption mechanisms, and the preservation of evidentiary integrity. Adopting an analytical and comparative methodology, the paper highlights how nanotechnological applications can revolutionize evidentiary tools through ultra-precise detection methods, invisible tracking technologies, and advanced systems for safeguarding the chain of custody. Furthermore, the study addresses the legal and ethical challenges associated with integrating nanotechnology into judicial frameworks, offering a forward-looking vision for its regulated adoption in a manner that balances technological innovation with the guarantees of fair trial standards.
