The publication analyses the Supreme Court’s case law on methods of determining compensation for civil liability of motor vehicle owners (OC PPM). In recent years, there has been an attempt to break the established, several-decade-old line of case law by assigning significant significance by the Supreme Court that determining the costs of vehicle repair is influenced by issues related to the actual repair or sale of the vehicle after damage. Damage understood in this way entails the need to settle it taking into account the so-called „dynamic nature of damage”. This approach has changed the previous settlement of the effects of a road collision, taking into account the approach that the extent of damage is updated at the time of its occurrence. The reference point for the analysis were the Supreme Court’s judgments issued at the turn of recent years and the possible consequences resulting from them, related to, among others: the violation of the constitutional right of injured parties to equality before the law. 

W publikacji analizie poddano orzecznictwo Sądu Najwyższego dotyczące metod ustalania odszkodowania z tytułu odpowiedzialności cywilnej posiadaczy pojazdów mechanicznych (OC PPM). W ostatnich latach nastąpiła próba przełamania utrwalonej, kilkudziesięcioletniej linii orzeczniczej poprzez przypisywanie istotnego znaczenia przez SN, że na ustalenie kosztów naprawy pojazdu mają wpływ kwestie związane z faktyczną naprawą czy sprzedażą pojazdu po szkodzie. Tak rozumiana szkoda niesie ze sobą konieczność jej rozliczania z uwzględnieniem tzw. dynamicznego charakteru szkody. Podejście takie zmieniło dotychczasowe rozliczanie skutków kolizji drogowej uwzględniającej podejście, że rozmiar szkody aktualizuje się w momencie jej powstania. Punktem odniesienia dla dokonywanej analizy stały się orzeczenia SN, wydawane na przełomie ostatnich lat, i możliwie wynikające w związku z nimi skutki, związane m.in. z naruszeniem konstytucyjnego prawa poszkodowanych do równości wobec prawa.
