Abstract

O presente artigo propõe-se a estudar o quimerismo a partir de questões jurídicas que problematizam o instituto na perspectiva da bioética e do biodireito, sobretudo pela leitura do tema pelos Direitos Humanos. Para tanto, está dividido em quatro partes, sendo a primeira a abordar o tema pelos conceitos do quimerismo para, em seguida, tratar das implicações a partir do caso dos gêmeos univitelinos. Em seguida, o artigo trata da importância da prova pericial sem considerar suas nuances problemáticas ao tema e, por fim, aborda o ponto sob a ótica da bioética, do biodireito e dos Direitos Humanos, pensando na formulação de políticas públicas como forma da possível solução e minimização do problema sociojurídico. Trata-se de pesquisa de revisão bibliográfica e documental, de viés qualitativo, desenvolvida pelo método dedutivo. Como resultados, apurou-se que o quimerismo e a situação gemelar univitelina são questões que refletem situações críticas na órbita jurídica e, por isso, merecemreflexão, aprofundamento científico interdisciplinar e soluções por meio da possibilidade de políticas públicas de atenção à saúde.

This article proposes to study chimerism based on legal issues that problematize the institute from the perspective of bioethics and biolaw, especially by reading the theme through Human Rights. To this end, it is divided into four parts, the first of which addresses the topic through the concepts of chimerism and then addresses the implications based on the case of identical twins. Next, the article deals with the importance of expert evidence without considering its problematic nuances to the topic and, finally, addresses the point from the perspective of bioethics, biolaw and Human Rights, thinking about the formulation of public policies as a possible solution. and minimization of the socio-legal problem. This is bibliographic and documentary review research, with a qualitative bias, developed using the deductive method. As a result, it was found that chimerism and the identical twin situation are issues that reflect critical situations in the legal sphere and, therefore, deserve reflection, interdisciplinary scientific deepening and solutions through the possibility of public health care policies.
