La forja del Estado democrático constitucional en Venezuela y su relación con la democracia integral

Abstract

El objetivo del presente trabajo es presentar los diversos enfoques desde la teoría política sobre la implantación de un régimen totalitarista en Venezuela. Se concluye que inició con una forma de democracia delegativa, a partir del 2005, que degeneró en un sistema autoritario competitivo (2012 en adelante), para devenir finalmente en sistema totalitario, a partir del conflicto de poderes entre Tribunal Supremo de Justicia y Asamblea Nacional, con el debilitamiento y aniquilación del Estado de derecho. Las acciones del Tribunal Supremo de Justicia ilegítimo, no sólo invadieron de manera inconstitucional competencias privativas de la Asamblea Nacional, bloqueando las funciones propias fundadas en un derecho “sobrevenido”, en función de parcialidades de carácter ideológico más que en la ley, lo que condujo al establecimiento de una democracia meramente de fachada, con rasgos totalitaristas, con la imposición e implantación de una Asamblea Constituyente espuria, modificando continuamente el texto Constitucional al servicio de la voluntad del Gobernante de turno, en este caso de estudio, de Nicolás Maduro. De esta manera, se conculcan a los ciudadanos su derecho a elegir, socavando la soberanía popular, de manera de haber minado completamente el mandato electoral expresado el 6 de diciembre de 2015 y los principios de la democracia integral.
