Abstract

espanolEl presente escrito pretende mostrar la vision que al respecto del Derecho internacional tiene la teoria del Derecho de H. L. A. Hart, la analogia entre los modelos de Derecho nacional e internacional, y las posibilidades de reglas de reconocimiento afincadas en el Derecho nacional, pero con vocacion internacional, y su operatividad dentro del estudio de los Sistemas Juridicos. La metodologia que se empleara es de tipo documental mediante el estudio dogmatico de la doctrina enmarcada en el estudio sobre Hart. EnglishThis article aims to reflect Hart´s International theory, his analogy between national and international model and the posibilities of recognition rules, established in national law, in an international view. Aditionally its operation within the study of Legal Systems. The methodology that will be used is documentary through the dogmatic study of the doctrine framed in the study about Hart.

تهدف هذه الوثيقة إلى إظهار الرؤية التي تتمتع بها نظرية قانون ه. ل. أ. هارت فيما يتعلق بالقانون الدولي، والقياس بين نماذج القانون الوطني والدولي، وإمكانيات قواعد الاعتراف القائمة على القانون الوطني، ولكن مع مهنة دولية، وعملها في إطار دراسة النظم القانونية. المنهجية التي سيتم استخدامها هي وثائقية من خلال الدراسة العقائدية للعقيدة المؤطرة في الدراسة على هارت. تهدف هذه المقالة إلى عكس نظرية هارت الدولية، وتشبيهه بين النموذج الوطني والدولي وإمكانيات قواعد الاعتراف، المنصوص عليها في القانون الوطني، من وجهة نظر دولية. كما يندرج تشغيلها ضمن دراسة النظم القانونية. المنهجية التي سيتم استخدامها هي وثائقية من خلال الدراسة العقائدية للعقيدة المؤطرة في الدراسة حول هارت.
