XALQARO HUQUQDA KONSULLIK NIKOHLARINING AHAMIYATI

Abstract

Mazkur maqola xalqaro huquq amaliyotida o‘ziga xos o‘rin egallagan konsullik nikohlari institutining nazariy-huquqiy asoslari va amaliy ahamiyatini yoritishga bag‘ishlangan. Maqolada konsullik nikohlarining huquqiy asoslari sifatida Vena konvensiyasining tegishli normalari, davlatlarning ichki qonunchiligi, ikki tomonlama konsullik bitimlari hamda xalqaro xususiy huquq prinsiplari tizimli ravishda tahlil qilingan. Konsulxonalar tomonidan tuzilgan nikohlarning haqiqiyligi, ularning qabul qiluvchi davlat tomonidan e’tirof etilishi va bunday nikohlar asosida yuzaga keladigan yuridik oqibatlar ilmiy jihatdan asoslab beriladi. Ayniqsa konsullik nikohlarining yurisdiksiya bilan bog‘liq jihatlari, konsulning vakolat chegaralari hamda nikohni ro‘yxatga olishda ikki davlat huquq tizimlari o‘zaro qanday uyg‘unlashishi masalalari alohida o‘rganilgan.
