Abstract

Ушбу мақолада коррупцияга оид жиноятларда жиноят субъекти тушунчаси, унинг ҳуқуқий табиати ва махсус субъекти белгиларининг аҳамияти илмий-амалий жиҳатдан ёритилган. Мақолада мансабдор шахснинг ҳуқуқий мақоми, ташкилий-бошқарув ва маъмурий-хўжалик ваколатларининг мазмун-моҳияти ҳамда уларнинг коррупцион хатти-ҳаракатлардаги роли таҳлил қилинади. БМТ ва Европа Кенгаши Конвенцияларидаги “жамоат мансабдори” таърифи миллий қонунчилик билан қиёсий ўрганилган. Шунингдек, хусусий сектор хизматчиларининг жавобгарлик субъекти сифатида киритилиши, маиший коррупция, манфаатлар тўқнашуви ва давлат хизматининг институционал асосларига оид назарий масалалар ёритилган.
