La responsabilidad tributaria de los administradores y directivos de las empresas familiares

Abstract

El presente trabajo examina, de manera minuciosa, las diversas responsabilidades tributarias en las que pueden incurrir los administradores y directivos de las empresas familiares. A estos efectos, se lleva a cabo, en primer lugar, la delimitación de los sujetos que pueden llegar a incurrir en alguna de las referidas responsabilidades, así como los requisitos necesarios para ostentar tal condición y la prueba de los mismos. Efectuado lo anterior, se examinan, de forma individualizada, los presupuestos específicos para que surjan cada una de las referidas responsabilidades, esto es, la derivada de la comisión de infracciones tributarias -prevista en el artículo 43.1 a) de la LGT-, la resultante del cese de actividades de la empresa familiar-persona jurídica -contemplada en el artículo 43.1 b) de la LGT- y la concerniente a la presentatación reiterativa de autoliquidaciones sin ingreso relativas a tributos que han de repercutirse o a cantidades que deben retenerse -regulada en el artículo 43.2 de la LGT-. El trabajo concluye con un análisis detallado del alcance o extensión de cada una de las responsabilidades tributarias anteriormente aludidas, distinguiendo, a estos efectos, entre el régimen aplicable, por un lado, a las sanciones y, por otro, a los diversos elementos de la deuda tributaria.
