Da tirania da maioria à tirania da norma fundamental

Abstract

As maiorias fazem a lei, não as minorias. Desta proposição deriva a investigação aseguir concernente ao quão abrangente deve ser o alcance legislativo de uma maioria e quaisas proteções inflexíveis que devem circundar as minorias. Se por um lado uma demformal é realizada pelo poderio das maiorias, a democracia substancial, por outro, abarca o rolde limites e ela impostos. Assim, através de normas fixas cujo conteúdo sensível deve serestipulado com demasiado cuidado, a maioria política se encontdireitos, o que significa dizer que um legislador ordinário jamais poderá alterar normashierarquicamente superiores, mas pelo contrário, tem seu poder de criação moldado pelasmesmas. A norma fundamental é tanto um bem como umfonte de poder arbitrário e inflexível.
