La parodia non è violazione del diritto d'autore: l'esperienza italiana e lo spettro della proprietà intellettuale europea

Abstract

Questo breve saggio mira a sostenere una tesi sulla scia degli studi critici dedicati alla proprietà intellettuale: nei sistemi giuridici occidentali il problema giuridico alla base del conflitto tra parodia e diritto d’autore non deve necessariamente essere formulato in termini di specifica eccezione al diritto esclusivo o in base a clausole generali di libera utilizzazione come il fair use statunitense, ma può (e deve) essere inquadrato alla luce del requisito di originalità dell’opera dell’ingegno. In altre parole, la parodia costituisce un’opera originale autonoma a dispetto delle sue somiglianze formali con l’opera parodiata. Per offrire argomenti a favore di questa tesi, analizzerò brevemente l’evoluzione del diritto alla parodia in Italia, con particolare attenzione alla giurisprudenza, riservandomi di tornare in futuro sull’argomento con approfondimenti comparatistici.
