Los derechos económicos, sociales y culturales en la Corte Interamericana de Derechos Humanos

Abstract

La obra expone la profunda brecha que existe entre el reconocimiento formal de los derechos económicos, sociales, culturales y ambientales (DESCA) y su cumplimiento real en sociedades como la mexicana, donde persisten graves problemas de pobreza, desigualdad, deterioro ambiental y carencias básicas. El autor explica el origen, naturaleza y evolución de estos derechos, subrayando que son tan obligatorios y justiciables como los derechos civiles y políticos. Asimismo, desarrolla el principio de progresividad, la obligación estatal de garantizar niveles mínimos esenciales y la necesidad de superar la visión tradicional que limitaba estos derechos a meras aspiraciones políticas. A partir del análisis de los criterios y sentencias de la Corte Interamericana de Derechos Humanos, el libro muestra cómo el litigio internacional ha fortalecido la justiciabilidad de los DESCA, evidenciando casos paradigmáticos en materia de derechos laborales, educación, seguridad social, propiedad colectiva y derechos culturales. Finalmente, destaca que la vigencia real de estos derechos no depende sólo de la acción estatal, sino también del activismo jurídico y la participación ciudadana, proponiendo líneas de acción para impulsar una cultura de exigibilidad efectiva que permita transformar las condiciones sociales y garantizar una vida digna para todos.
