
The disposition of land under Certificate of Customary Right of Occupancy allocated by the village council is crucial transaction because population is expanding in Tanzania that makes people to buy land under customary tenure. The buying of customary tenure under CCRO has got some challenges since many buyers face double sale of land and fraud in Tanzania the circumstance that make some of fidelity buyers to incur unnecessary losses. Among of the challenges that buyers of land face in CCRO is the lack of uniformity in customary law to regulate the sale of land, the lack of formal registry to search for encumbrances and defect of title under CCRO and the Village Land Act does not provide any guidance about sale of land in customary right of occupancy in Tanzania. This paper addresses these challenges and suggests recommendations thereto.
