Direitos coletivos e controle judicial de políticas públicas

Abstract

Trata-se de apontamentos sobre a necessária reflexão a respeito do controle judicial de políticas públicas quando a demanda envolvida tratar sobre a tutela de direitos coletivos. Assim, a perspectiva da saúde é apenas um exemplo de fundo diante da necessidade de uma teorização mais consistente sobre como o Judiciário deve desempenhar o seu papel no controle externo da Administração Pública para o caso de direitos estrita ou propriamente coletivos pertencentes a uma determinada coletividade. Argumenta-se que, nesses casos, a tutela cognitiva deve ser sempre coletiva, mas a execução deve ser feita individualmente, e que o Judiciário, a exemplo da Administração Pública, deve observar estritas e inafastáveis limitações.
