Instrumentalismo x Neoinstitucionalismo: uma avaliação das críticas neoinstitucionalistas à teoria da instrumentalidade do processo

Abstract

O texto compara duas propostas contemporâneas de abordagem ao processo civil brasileiro: o Instrumentalismo, de Dinamarco; e o Neoinstitucionalismo, de Rosemiro Pereira Leal. Contrariando o pensamento predominate atualmente, o Instrumentalismo é aqui exposto como uma tentativa de superação ideológica do pensamento processual que o antecedeu, paradoxalmente marcada por uma continuidade teórica acrítica. Quanto ao Neoinstitucionalismo, destaca-se a possibilidade de que venha a se tornar uma crítica racional anacrônica ao Instrumentalismo. Isso aconteceria porque as inovações legislativas impõem ao juiz a aplicação de teses jurídicas fixadas nas instâncias superiores. Dessa forma, seria bastante limitada a atuação do julgador instrumentalista, de perfil jurídico mais flexível e maior engajamento social.
