O direito fundamental à propriedade e o princípio da insignificância no HC106498

Abstract

Investiga-se o princípio da insignificância como possível obstáculo ao direitofundamental à propriedade. A partir de uma análise do Habeas Corpus n° 106498/2012,torna-se possível averiguar como o tema avança no tempo desde a decisão simbólica doHC nº 84.412/2004. O método é o qualitativo por pesquisa bibliográfica. A hipóteseaponta que dito princípio, mesmo ao tornar uma subtração patrimonial atípica, não seráum obstáculo à preservação da propriedade, isso por não excluir o delito, mas apenas atipicidade penal. Conclui-se por identificar menor flexibilidade na aplicação do princípiodada a incorporação de rígidos requisitos à concessão.
