Abstract

La multiplication des lois autorisant la déchéance de nationalité pour motifs de sécurité nationale constitue l’une des évolutions les plus préoccupantes du droit de la nationalité contemporain. Cet article examine comment la lutte contre le terrorisme a conduit de nombreux États démocratiques à réintroduire ou à élargir des mécanismes de dénationalisation qui avaient été progressivement abandonnés après la seconde guerre mondiale en raison de leurs connotations autoritaires. À travers une analyse juridique comparative portant sur une vingtaine de pays et un examen approfondi de la jurisprudence internationale, nous démontrons que ces mesures créent un risque systémique d’apatridie, violent le principe de non-discrimination et remettent en question le caractère fondamental du droit à la nationalité. L’article propose un cadre normatif alternatif pour concilier les impératifs légitimes de sécurité nationale avec le respect des droits humains fondamentaux, en s’appuyant sur les principes de proportionnalité, de nécessité et de non-arbitraire consacrés par le droit international.
