
Abstract:Der Essay begründet die ontologischen Voraussetzungen der Systemischen Rechtsentwicklung und zeigt, warum Recht, Staat und Mensch Teil der Mitwelt sind, deren Funktionsfähigkeit sie schützen. Daraus folgt eine verfassungslogische Verschiebung hin zu präventivem Funktionsschutz im Umwelt- und Verwaltungsrecht. Der Text erläutert Art. 20a GG als Funktionsprinzip staatlicher Selbstkorrektur und ordnet Rechte der Natur als Ausdruck dieser ontologischen Lage ein. Er bildet die theoretische Grundlage für das Volksbegehren „Rechte der Natur – Bayern“ und die praktische Anwendung bestehender Verwaltungsnormen.
