Drohende Verjährung von Verlustscheinen
Anfang Januar 2017 verjähren die noch unter dem alten SchKG ausgestellten Verlustscheine, für die ursprünglich noch keine Verjährung lief. Ebenfalls beginnen ab diesem Zeitpunkt die Verjährungsfristen der Verlustscheine des neuen SchKG abzulaufen. Was ist zu tun? Au début janvier 2017, les créances constatées par des actes de défaut de biens délivrés avant l’entrée en vigueur de la nouvelle LP se prescrivent. Sous le régime de l’ancienne LP, ces créances étaient imprescriptibles. En même temps, les créances constatées par des actes de défauts de biens issus sous l’empire de la nouvelle LP commencent à se prescrire. Qu’est-ce qu’il faut faire face à cette situation?
