🧭 Abstract (English) This document presents the first officially recorded citizen submission in Germany combining § 13 of the Administrative Procedure Act of North Rhine-Westphalia (VwVfG NRW) with Article 20a of the German Basic Law (Grundgesetz).It was submitted in October 2025 to the Ministry for the Environment, Nature Conservation and Transport of North Rhine-Westphalia (MUNV) and the Mining Authority Arnsberg. The submission calls for a constitutional review of ongoing mining and soil-movement activities in the Hambach lignite area, referring to the State’s constitutional duty to protect the natural foundations of life.By linking a low-threshold procedural norm (§ 13 VwVfG NRW) with the constitutional environmental mandate (Art. 20a GG), this case illustrates a new form of systemic legal development — activating existing law rather than creating new rights.
