Abstract

🧭 Abstract (English) This document presents the first officially recorded citizen submission in Germany combining § 13 of the Administrative Procedure Act of North Rhine-Westphalia (VwVfG NRW) with Article 20a of the German Basic Law (Grundgesetz).It was submitted in October 2025 to the Ministry for the Environment, Nature Conservation and Transport of North Rhine-Westphalia (MUNV) and the Mining Authority Arnsberg. The submission calls for a constitutional review of ongoing mining and soil-movement activities in the Hambach lignite area, referring to the State’s constitutional duty to protect the natural foundations of life.By linking a low-threshold procedural norm (§ 13 VwVfG NRW) with the constitutional environmental mandate (Art. 20a GG), this case illustrates a new form of systemic legal development — activating existing law rather than creating new rights. The approach treats constitutional environmental protection not as a declarative norm but as a practical state duty, integrating precaution and ecological integrity into administrative practice.It marks a step toward a learning, reflexive understanding of environmental governance within constitutional democracies. 🧩 Description Part of the research series “Systemic Legal Development (Bader 2025)”.This record represents the first documented application of the method within German administrative law.It establishes the legal and methodological foundation for subsequent submissions (e.g. Olympia Bavaria 2025), combining § 13 VwVfG NRW with Art. 20a GG to operationalize the constitutional duty of environmental protection through administrative practice.
