O ABAETÉ COMO SUJEITO DE DIREITOS: DIÁLOGOS SOBRE CONFLITOS, PATRIMÔNIO E O SAGRADO

Abstract

Este artigo analisa as dinâmicas históricas, culturais, jurídicas e ambientais do sítio natural sagrado das Dunas e Lagoas do Abaité, em Salvador/BA, reconhecido como Área de Proteção Ambiental. O estudo evidencia conflitos relacionados à especulação imobiliária, racismo ambiental, ocupações irregulares e crimes ambientais, que ameaçam o valor simbólico e histórico da região. Com abordagem interdisciplinar, a pesquisa destaca a herança Tupinambá, o Quilombo Buraco do Tatu e as manifestações populares de resistência, articulando cultura, oralidade e patrimônio imaterial. No campo jurídico, discute-se a omissão legislativa e sua repercussão sobre direitos difusos e coletivos, como o meio ambiente equilibrado, o local de culto religioso e o patrimônio cultural. O trabalho dialoga com o Novo Constitucionalismo Latino-Americano, a concepção da Natureza como sujeito de direitos e os direitos de terceira geração. Conclui-se pela necessidade de políticas públicas inclusivas que integrem tradição, direito e proteção ambiental, reafirmando o Abaité como sítio sagrado e patrimônio cultural diante dos desafios das mudanças climáticas.
