Abstract

Abstract:The Cognitive Entrapment Prevention and Transparency Act (CEPTA) proposes a comprehensive legal framework to define, detect, and prohibit manipulative communication practices that blend emotional conditioning with factual falsehoods—termed Cognitive Entrapment. The Act introduces the Affective Entrapment Score (AES), a standardized audit metric for identifying emotionally manipulative falsehoods in mass and targeted communications. CEPTA establishes the Office for Cognitive Integrity (OCI), tasked with auditing, enforcement, and oversight of campaigns, platforms, and AI systems involved in public communications. The Act balances transparency, accountability, and free-speech protections through tiered mens rea standards, AES-based pre-distribution audits, and safe harbors for good-faith compliance.
