Abstract

Problem statement. Recently, the role of the Ukrainian bar has significantly increased under martial law, when, against the backdrop of large-scale security and social transformations, lawyers are entrusted with the critically important task of ensuring the effective protection of human rights and freedoms. The wartime context generates both new challenges and systemic problems that may discredit the legal profession and lead to violations of citizens’ rights. The purpose is to analyse the essence and the most important aspects of advocacy activity under martial law. Methods. Analytical method – to identify key trends in the transformation of advocacy during the war; system-structural method – to establish the interrelation between social, legal, and security factors affecting the work of lawyers; comparative-legal method – to contrast wartime and peacetime conditions of implementing professional guarantees for lawyers; generalisation – to formulate conclusions regarding the cooperation potential of the bar, civil society, and international partners. Results. It is substantiated that during the war the social component of advocacy has significantly intensified, particularly in providing free legal assistance to the most vulnerable categories of the population. It is demonstrated that cooperation with civil society organisations and international institutions, including participation in the "PravoVsim" project implemented by the Danish Refugee Council, contributes to expanding citizens’ access to legal services. A number of problematic situations have been identified, some of which are systemic and pose threats to the professional activity of lawyers and the realisation of constitutional rights. Conclusions. It is confirmed that the bar plays a key role in ensuring legal stability and protecting human rights under martial law. At the same time, significant challenges persist, related to pressure on the profession, restricted access to clients, and general security barriers. Strengthening cooperation between the bars, civil society, and international partners, as well as improving mechanisms of professional guarantees, is essential for the effective performance of lawyers both during and after the war.
