ПРИМЕНЕНИЕ ИНСТРУМЕНТОВ «МЯГКОГО ПРАВА» В АНТИТЕРРОРИСТИЧЕСКОЙ ДЕЯТЕЛЬНОСТИ

Abstract

В данной статье рассматривается феномен мягкого права как важного инструмента международного сотрудничества в сфере противодействия терроризму. Проведён анализ ключевых форм мягкого права — резолюций, деклараций, рекомендаций международных организаций (ООН, ОБСЕ, ФАТФ и др.), а также дана оценка их влияния на формирование и развитие национальных стратегий и законодательства в ряде государств. Особое внимание уделяется примерам имплементации норм мягкого права в практике Франции, Германии, Финляндии и других стран. Сделан вывод о том, что, несмотря на отсутствие формально-обязательной силы, мягкое право эффективно выполняет функцию нормативного и политического регулирования, способствуя выработке согласованных международных стандартов и укреплению международной легитимности в сфере антитеррористической деятельности.
