Abstract

Este artículo analiza el debate en torno al “Duende de Baños”, diferenciando entre el duende como concepto folclórico genérico y el “duende de Baños” como obra artística contemporánea, creada en 2013 por Fito Girolami y Catalina Lucz-Ligeti. A través de un enfoque comparativo, se demuestra que esta obra no es abstracta ni de dominio público, sino una creación con autoría identificable, estética definida y trayectoria documentada. El texto plantea la necesidad de reconocerla como obra protegible bajo el marco jurídico de la propiedad intelectual y como parte del patrimonio cultural vivo. Abstract (English)This article examines the debate surrounding the “Duende of Baños,” distinguishing between the folkloric, generic notion of the duende and the “Duende of Baños” as a contemporary artistic creation, developed in 2013 by Fito Girolami and Catalina Lucz-Ligeti. Through a comparative approach, the paper demonstrates that this work is neither abstract nor public domain, but rather an original creation with identifiable authorship, aesthetic definition, and documented trajectory. It argues for recognition of the “Duende of Baños” as a protectable work under intellectual property frameworks and as part of living cultural heritage.
