Abstract

En el ordenamiento jurídico peruano, los actos de sustitución interna subsumido bajo el “Esquirolaje interno”, no se encuentra regulado como conducta prohibitiva por la ley; menos aún, una sanción determinada por la comisión de este tipo de conductas. Por estos motivos, se estableció como objetivo analizar de qué manera la falta de regulación del esquirolaje interno permite el ejercicio abusivo de la ius variandi del empleador. Respecto a la metodología utilizada, se aplicó un enfoque de corte cualitativo, descriptivo-fenomenológico; como instrumento de recolección de datos “Guía de Entrevista”, con el cual se obtuvo como resultado que, la ausencia de regulación del esquirolaje interno permite que los empleadores utilicen el ius variandi de manera abusiva, al reasignar funciones y tareas de los trabajadores en periodo de huelga con aquellos que no participaron en la misma, afectando significativamente la efectividad de esta medida de presión.
