IMPLICACIONES LEGALES DE LA DEROGACIÓN DE LA IMPROCEDENCIA DE LA

Abstract

La derogación de la improcedencia de la conclusión anticipada ha generado un contexto significativo de incertidumbre en la protección de los derechos fundamentales dentro de los procesos judiciales. Este estudio se propone analizar estas implicaciones, considerando la relevancia de la protección de garantías fundamentales como la presunción de inocencia y el derecho a la defensa. La investigación, realizada como un artículo de revisión sistemática aplicándose el método PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses), donde se han evaluado diversas perspectivas sobre cómo esta derogación puede comprometer las garantías procesales de los imputados y exacerbar las desigualdades en el acceso a la justicia. Los hallazgos indican que, si bien la derogación apunta a agilizar los procedimientos judiciales, resulta ser una fuente de riesgo para las libertades fundamentales, ya que reduce la capacidad de defensa efectiva y aumenta la posibilidad de sanciones antes de que se cumpla con el debido proceso. En conclusión, este trabajo destaca la necesidad de un enfoque equilibrado que permita la celeridad procesal sin sacrificar los derechos humanos, sugiriendo que las intervenciones futuras deben centrarse en desarrollar marcos normativos que fortalezcan las garantías judiciales en un contexto de rapidez. La investigación invita a considerar cómo las reformas legales pueden aplicarse sin comprometer la justicia ni los derechos de los ciudadanos involucrados
