Optimierungspotentiale der Novel Food-Verordnung – Analyse und Lösungsvorschläge

Abstract

Die Novel Food-Verordnung (EU) 2015/2283 stellt einen zentralen Baustein des europäischen Lebensmittelrechts dar. Mit ihrer Einführung verfolgte der europäische Gesetzgeber das Ziel, Innovationen im Lebensmittelsektor zu fördern und gleichzeitig ein hohes Maß an Lebensmittelsicherheit zu gewährleisten. Die Verordnung löste zum 1. Januar 2018 die bis dahin geltende Verordnung (EG) Nr. 258/97 ab und führte zu wesentlichen Änderungen, insbesondere durch die Zentralisierung des Zulassungsverfahrens und die Einführung eines vereinfachten Verfahrens für traditionelle Lebensmittel aus Drittländern.Die Verordnung hat zwar zu einer Vereinheitlichung der Zulassungspraxis geführt, dennoch bestehen weiterhin praktische Herausforderungen bei der Implementierung. Diese betreffen sowohl verfahrensrechtliche als auch materiellrechtliche Aspekte sowie Fragen des Vollzugs. Nach mehr als sieben Jahren Anwendungspraxis zeigen sich somit verschiedene Optimierungspotentiale, die in dieser Arbeit aufgezeigt werden sollen.
