Abstract

El estudio crítico-jurídico acerca de la interpretación y uso del principio del interés superior del niño en la ley ecuatoriana, valorando su efectividad en la salvaguarda de los derechos de los menores en el sistema judicial representa una actividad fundamental para garantizar los derechos del niño. El presente estudio se centra en la implementación de un método multicriterio neutrosófico para evaluar el análisis crítico-jurídico sobre la interpretación y aplicación del principio del interés superior del niño en la legislación ecuatoriana. Los hallazgos indican que, aunque la ley ecuatoriana ha establecido el interés superior del niño como un principio fundamental, su implementación plantea retos en cuanto a garantías legales y procedimientos. Mediante el método inductivo, se detectaron irregularidades en la interpretación del derecho judicial, lo que pone de manifiesto la necesidad de un enfoque más equitativo y uniforme en la salvaguarda de los derechos del menor. En cambio, el enfoque deductivo posibilitó situar estos descubrimientos dentro del contexto legal nacional e internacional, resaltando la relevancia de acuerdos como la Convención sobre los Derechos del Niño.
