Método neutrosófico para evaluar las estrategias multidisciplinarias de motivación y reinserción social de reclusos en prisión preventiva

Abstract

El presente estudio aborda la naturaleza de la institución de la prisión preventiva como una medida cautelar que, al privar de libertad a una persona antes de determinar su culpabilidad, genera tensiones con principios garantistas del proceso penal y puede obstaculizar la rehabilitación. A pesar de su carácter excepcional, esta práctica se ha vuelto común en diversos sistemas legales, provocando un debate acerca de su legitimidad y la necesidad de establecer restricciones claras en su aplicación. En este contexto, la investigación tiene como objetivo implementar un Método neutrosófico para evaluar las estrategias multidisciplinarias de motivación y reinserción social de reclusos en prisión preventiva. Se analizarán tácticas que potencien la motivación de los individuos y fomenten su reincorporación social, considerando tanto los derechos personales perjudicados como los factores psicológicos, sociales y legales que impiden el cambio y la rehabilitación. Además, se cuestionará si la actual aplicación de la prisión preventiva contribuye al control penal o, por el contrario, limita el acceso a programas de rehabilitación efectivos. Esta investigación motiva la toma de acciones integrales que permitan un equilibrio entre la protección de los derechos humanos y los intereses sociales, transformando el confinamiento preventivo en un proceso de transformación positiva que mejore las circunstancias de quienes enfrentan esta situación.
