PERKEMBANGAN TASYRI' PADA MASA JUMUD DAN TAQLID

Abstract

Penelitian ini mengkaji masa Jumud dan Taqlid dalam perkembangan hukum Islam, yang ditandai dengan stagnasi pemikiran hukum akibat ketergantungan pada mazhab dan berkurangnya praktik ijtihad. Penelitian ini menggunakan metode studi literatur untuk mengumpulkan dan menganalisis berbagai referensi yang relevan terkait dengan perkembangan penetapan hukum islam pada masa jumud dan taqlid Taqlid mengacu pada mengikuti pendapat ulama tanpa penelitian sendiri, sementara Jumud menggambarkan kebekuan pemikiran. Sejak abad ke-4 Hijriah, hukum Islam tidak lagi digali dari al-Qur'an dan Sunnah, melainkan mengikuti pendapat ulama terdahulu. Tertutupnya pintu ijtihad semakin memperburuk kondisi ini, meskipun beberapa ulama seperti Imam al-Syaukani berpendapat bahwa pintu ijtihad tetap terbuka. Ulama seperti Ibn Hazm, al-Ghazali, dan Ibn Taimiyyah berusaha mengembangkan hukum Islam melalui metode ijtihad terbatas. Penelitian ini bertujuan untuk memahami penyebab, dampak, dan kontribusi ulama dalam menjaga keberlanjutan ijtihad dalam menghadapi tantangan zaman.
