
O trabalho examina a prática da delegação de competências na administração pública brasileira. O autor a considera uma ferramenta essencial para a eficiência e flexibilidade, mas que enfrenta limitações legais e excessos sob o crivo do controle. Ele analisa a legislação vigente e aponta lacunas, especialmente em relação às delegações intrassubjetivas. Uma preocupação central é a responsabilização dos delegantes pelas Cortes de Contas, muitas vezes baseada nas teorias da culpa in eligendo e in vigilando, o que pode desincentivar a delegação. O artigo conclui que, embora a delegação seja vital, sua aplicação eficaz requer um arcabouço normativo mais claro e critérios de responsabilização mais precisos para promover a eficiência organizacional e a segurança jurídica.
The paper examines the practice of delegating competencies in Brazilian public administration. The author considers it an essential tool for efficiency and flexibility, but one that faces legal limitations and excess under the scrutiny of control. He analyzes current legislation and points out gaps, especially in relation to intra-subjective delegations. A central concern is the accountability of delegators by the Courts of Auditors, often based on the theories of culpa in eligendo and in vigilando, which can discourage delegation. The article concludes that although delegation is vital, its effective application requires a clearer regulatory framework and more precise accountability criteria to promote organizational efficiency and legal certainty.
