Abstract

Uno de los impactos de la IA en el Derecho consiste en generar diagnosticos sociológicos sobre patrones de transgresión, contravención y delito, para integrar propuestas de política criminal, proceso penal y legislación penal. Se analiza el salto de la criminología situación y del lugar a la criminología generada por la IA, a partir de la data científica internacional disponible. Entendidas dentro del marco de análisis del principio de inocencia y los riesgos del punitivismo, se identifican cuatro tendencias: a) la aproximación tradicional, basada en la observación personal de las relaciones reales (sea por medios reales o virtuales), b) la nueva aproximación oportunista, basada en patrones de oportunidad delictiva permitiendo predicción en la estrategia territorial, c) la nueva aproximación actancial, basada en la identificación de patrones grupales, sociales o individuales y d) la nueva aproximación terapéutica, que utiliza la data generada por IA para desarrollar procesos terapéuticos en el área de la rehabilitación individual. A partir de las fuentes, se discuten los efeectos de la IA en derecho políticos y civiles como privacidad, libertad y en general, la ética. Se concluye acerca de los peligros de la tercera aproximación, por cuanto presenta riesgos de confundir el diagnóstico cualitativo complejo con la naturaleza inferencial de la data. Se recomienda fortalecer el ángulo cualitativo y los principios éticos de nutralidad de la red, como fuente y regulación del proceso de IA con el objetivo de fortalecer los principios republicanos.

One of the impacts of AI on Law is to generate sociological diagnoses on patterns of transgression, contravention and crime, to integrate proposals for criminal policy and penal legislation. We analyzed the leap from situational and place criminology to pattern-based criminology, generated by AI, based on the available international scientific data. Understood within the framework of analysis of social vulnerability and the risks of punitivism, We identified four trends: a) The traditional approach, based on personal observation of real relationships (whether by real or virtual means), b) The new opportunistic approach, based on patterns of criminal opportunity allowing prediction in the territorial strategy, c) The new actantial approach, based on the identification of group, social or individual patterns, and d) The new therapeutic approach, which uses data generated by AI to develop therapeutic processes in the area of personal rehabilitation. Based on the sources, rights such as privacy and freedom generated by the intelligent digital dimension are discussed and a conclusion is drawn about the dangers of the third trend, as it presents risks of confusing the complex qualitative diagnosis with the inferential nature of data. It is recommended to strengthen the qualitative angle and the ethical principles of network neutrality, as a source and regulation of the AI process to strengthening Republican principles.
