Abstract

La jurisprudencia del Tribunal Europeo de Derechos Humanos (en adelante, “el Tribunal” o “el TEDH”) de 2022 en materia de medio ambiente consolida la idea de que la exposición a la polución que sobrepasa el umbral permitido por la Ley supone un riesgo que viola el Convenio Europeo de Derechos Humanos (en adelante, “el Convenio” o “el CEDH”). Ya no se requiere acreditar, siempre y en todo caso, el daño efectivo en la salud individual para considerar que ha habido una violación del derecho al respeto de la vida privada y familiar. Esta idea se plantea en las sentencias recaídas en los casos Solyanik c. Rusia, de 10 de mayo de 2022, Pavlov y Otros c. Rusia, de 11 de octubre de 2022 y Kotov y Otros c. Rusia, de 11 de octubre de 2022. La prolongación de la polución que pone en peligro la salud de los demandantes y la del conjunto de la población que reside en la zona de riesgo implica una interferencia injustificada en el interés de las personas bajo la jurisdicción de los Estados del Consejo de Europa a no sufrir violaciones graves del medio ambiente que pueden afectar a su bienestar y vida privada (SSTEDH Ardimento y Otros, Briganti y Otros, Perelli y Otros, A.A. y Otros c. Italia, de 5 de mayo de 2022). Por lo demás, resulta de interés también la línea asumida por el TEDH procedente del derecho polaco según la cual las normas favorables en materia de urbanismo no serán retroactivas, no servirán para legalizar actuaciones ilegales anteriores, pues supondría una discriminación para los demás administrados que construyeron -y construyen- legalmente (Decisión de Inadmisión Paweł SZCZYPIŃSKI c. Polonia, de 18 de enero de 2022). En fin, el derecho a la protesta pacífica sobre temas de interés general como es la cuestión de la protección de los paisajes históricos ampara el recurso al lenguaje grosero, que puede molestar a los demás, como una herramienta lingüística para expresar el rechazo frontal a la construcción de un proyecto urbanístico (sentencia Paradze y Otros c. Georgia, de 15 de diciembre de 2022).
