Analysis of Electronic Evidence Admissibility under the Bhartiya Sakshya Adhiniyam, 2023

Abstract

With the ongoing technological media mainly using computers, there has been a surge in illegal behavior also associated with digitalization. It is so big now that electronic evidence rears its head in any criminal case. However, with so many criminal cases involving electronic evidence on the rise at an exponential rate, this new form of proof has occasionally outstripped the capacity and services of both courts as well as law enforcement to handle these fresh issues. Digital/Digital Evidence: All computer-generated evidence should be collected, kept closed or shared and presented to comply with legal standards of admissibility. Some of the common conventional crimes such as fraud, criminal breach of trust and money laundering have also adopted more complex ways facilitated by technology. The Indian Evidence Act of 1872 is a procedural law in India that gives specific rules as to which evidence is relevant in a particular case. One, electronic proof described a paperless record of any presentation or oversight sent to the court for the judge’s perusal with an. when its objective is to be used for substantiating or disagreeing with a truth that might be under contention.
