Plenitude de defesa e seletividade penal: a tese da legítima defesa em casos de letalidade policial no Tribunal no Júri

Abstract

Este artigo analisa criticamente o uso da tese da legítima defesa no Tribunal do Júri em casos de violência policial no Brasil, traçando um paralelo com a tese da legítima defesa da honra, já declarada inconstitucional pelo Supremo Tribunal Federal. A violência policial, marcada por seletividade racial e estrutural, reflete o legado histórico de racismo e autoritarismo no País. O texto examina o princípio da plenitude de defesa no Tribunal do Júri, que permite argumentações amplas, mas também abre espaço para teses discriminatórias. Através de casos emblemáticos, como o de Emily e Rebeca, discute-se como a tese da legítima defesa tem sido utilizada para justificar mortes violentas praticadas por agentes do Estado, perpetuando a desresponsabilização e a desvalorização da vida periférica. Conclui-se que a naturalização dessas narrativas jurídicas reforça desigualdades e impede avanços normativos e institucionais necessários para garantir maior controle e transparência na atuação policial.
