Abstract

This legal opinion analyses the legal and ethical framework for the publication and subsequent use of species occurrence data using the example of the GfI fish species atlas. The report was commissioned to clarify the authorisations of the operators to share the data collected over the years with the Global Biodiversity Information Facility (GBIF). The GfI Fish Species Atlas, a collaboration between the Gesellschaft für Ichthyologie e.V. (German Ichthyological Society) and Hochschule Bremen – City University of Applied Sciences, comprises over 120,000 data records on fish species, which have been collected using various methods and with the support of volunteers and students. The report gives an introduction to a number of fields that are relevant to the decision: Copyright, database rights, data protection, research ethics and licensing. Using the fish species atlas as an example, the report explains the authorisations for subsequent use and the arrangements that should be made for sharing species occurrence data. In summary, there is only little standing in the way of the data being shared with GBIF. As a provisional measure, however, the consent of the volunteer reporters should be obtained, including anonymised disclosure if necessary, and the terms of use and data protection provisions on the GfI Fish Species Atlas website should be adapted correspondingly.

Das wissenschaftliche Gutachten untersucht die rechtlichen und ethischen Rahmenbedingungen für die Veröffentlichung und Nachnutzung von Artvorkommensdaten am Beispiel des GfI-Fischartenatlas. Das Gutachten wurde beauftragt, um die Befugnisse der Betreiber zur Weitergabe der über Jahre gesammelten Daten an die Global Biodiversity Information Facility (GBIF) zu klären. Der GfI-Fischartenatlas, eine Zusammenarbeit zwischen der Gesellschaft für Ichthyologie e.V. und der Hochschule Bremen, umfasst über 120.000 Datensätze zu Fischarten, die durch verschiedene Methoden und mit Unterstützung von Ehrenamtlichen und Studierenden gesammelt wurden. Das Gutachten führt in verschiedene Gebiete ein, die für die Entscheidung maßgeblich sind: Urheberrecht, Rechte an Datenbanken, Datenschutz, Forschungsethik und Lizenzierung. Jeweils am Beispiel des Fischartenatlas wird erläutert, wie es um die Befugnisse zur Nachnutzung bestellt ist und welche Vorkehrungen zur Weitergabe der Artvorkommensdaten getroffen werden sollten. In der Zusammenschau steht der Weitergabe des Datenschatzes an GBIF wenig im Wege. Vorsorglich sollte jedoch die Zustimmung der freiwilligen Fundmelder:innen eingeholt werden, ggf. auch zu einer anonymisierten Weitergabe, und die Nutzungs- sowie Datenschutzbestimmungen auf der Webseite des GfI-Fischartenatlas entsprechend angepasst werden.
