Multiple crises: responses in agricultural law Polish report

Abstract

L'accumulation des phénomènes de crise au cours des dernières années, provoqués principalement par la pandémie de Covid-19, mais aussi par la guerre en Ukraine, nécessite l'adaptation des outils juridiques existants à de nouveaux défis. Notre attention se portera bien sûr sur les instruments juridiques étroitement liés au droit agricole. Il ne fait cependant aucun doute que ces instruments ne peuvent être analysés indépendamment des conditions/déterminants politiques et sociaux. Il convient de souligner que les mécanismes juridiques utilisés jusqu'à présent, tant dans le cadre du droit communautaire au sens large que dans celui du droit national correspondant, s'avèrent insuffisants dans une situation de crise, et c'est sans aucun doute la situation à laquelle nous sommes confrontés. Die Häufung von Krisenphänomenen in den letzten Jahren, die vor allem durch die Covid-19-Pandemie, aber auch durch den Krieg in der Ukraine verursacht wurden, erfordert die Anpassung der bestehenden Rechtsinstrumente an neue Herausforderungen. Unser Augenmerk gilt natürlich den Rechtsinstrumenten, die eng mit dem Agrarrecht verbunden sind. Es kann jedoch kein Zweifel daran bestehen, dass diese Instrumente nicht unabhängig von politischen und sozialen Bedingungen/Determinanten analysiert werden können. Es ist zu betonen, dass sich die bisher genutzten Rechtsmechanismen, sowohl im Rahmen des weit verstandenen EU-Rechts als auch des damit verbundenen nationalen Rechts, in einer Krisensituation als unzureichend erweisen, und das ist zweifellos die Situation, mit der wir es zu tun haben.
