La ordenación y evaluación ambiental de la movilidad urbana sostenible

Abstract

El presente Capítulo pretende, en primer lugar, abordar la ordenación de la movilidad sostenible desde las normas ambientales, diferenciando entre aquellas que ordenan sustantivamente la movilidad como un sector que ha de contribuir a la consecución de objetivos ambientales como los relacionados con la reducción de GEI y aquellas otras normas que sujetan los instrumentos jurídicos de movilidad a condicionantes ambientales, de forma que no pueden ser ajenos por las normas ambientales en sentido estricto. No obstante, el Capítulo debe completarse con el examen de esa otra ordenación de la movilidad urbana sostenible a la que antes me refería y en la que lo ambiental es sólo un elemento más de la regulación, planteando, en este caso la necesidad de vislumbrar el grado de sustantividad de la movilidad urbana sostenible como sector específico del Derecho Administrativo con características propias.
