Abstract

La presente monografía se ocupa de estudiar los avances en materia de digitalización del proceso judicial. Las tecnologías de la información y comunicación facilitan un procedimiento más eficaz, más ágil y transparente y, además, permiten deslocalizar el trabajo de las propias oficinas judiciales al existir la posibilidad de prestar los servicios a distancia evitando acumulaciones derivadas de la tramitación de los procedimientos. La utilización del expediente digital y la posibilidad de automatizar ciertos procesos contribuirá, en el futuro, a la incorporación en el proceso de herramientas tecnológicas más avanzadas. Lograr que estos avances se apliquen con efectividad depende de la generalización de su uso, de la interoperabilidad real y de la seguridad necesarias en los sistemas de gestión procesal. Además de los beneficios el uso de esta tecnología en la actividad jurisdiccional conlleva también riesgos en la protección de los datos personales. Se analiza el régimen jurídico del derecho a la protección de los datos personales en los órganos judiciales y la necesidad de una regulación procesal específica que les dote de mejor protección. Se plantea la incidencia del derecho fundamental a la protección de los datos personales en el derecho a la tutela judicial efectiva y en el principio de publicidad de las actuaciones judiciales.
