Abstract

RESUMEN El incremento de los delitos cometidos a través de los medios informáticos o tics han originado la necesidad de sucesivas reformas en el Código Penal aunque ha resultado una regulación dispersa. En el presente capítulo se tratan los aspectos más relevantes del delito de descubrimiento y revelación de secretos, cuyo bien jurídico protegido es, en algunos casos, la intimidad y en otros la privacidad. Se distinguen las conductas que conllevan un apoderamiento de los datos reservados de aquellas que consisten en una interceptación de la telecomunicaciones o mediante dispositivos de grabación de la imagen y el sonido, subtipos agravados según el autor, el medio o la posterior divulgación, recaigan sobre datos sensibles, ánimo de lucro o afecten a menores o personas con discapacidad, igualmente se destaca la importancia de la prueba pericial informática y las reformas al respecto a fin de dar cumplimiento a la directiva 2013/40/UE de 12 de agosto.
