Abstract

Resumen A lo largo de la historia, las misiones diplomáticas han sido instituciones esenciales para mantener el diálogo y la estabilidad entre las naciones, garantizando un espacio de inviolabilidad, incluso en situaciones de tensión política. Este artículo examina un evento que marcó un punto de inflexión en la aplicación de estos principios: el asalto a la Embajada de México en Ecuador. El objetivo principal de este estudio es analizar las implicaciones jurídicas de este evento en el ámbito del Derecho Internacional y el Derecho Penal. La investigación se basa en una metodología cualitativa fundamentada en el análisis documental de fuentes secundarias, incluyendo documentos oficiales, artículos académicos y noticias. Los principales hallazgos revelan que el asalto violó principios fundamentales del derecho internacional, como la inviolabilidad de las misiones diplomáticas y el derecho de asilo. Además, se identificaron posibles delitos penales, tales como el uso desproporcionado de la fuerza y la detención arbitraria. El estudio concluye que este incidente representa un grave retroceso en el respeto al derecho internacional y los derechos humanos, socavando la estabilidad de las relaciones diplomáticas. Por ende, se enfatiza la necesidad de que los Estados fortalezcan los mecanismos para garantizar el cumplimiento de las normas internacionales y armonicen su legislación interna con sus obligaciones globales.

Abstract Throughout history, diplomatic missions have been essential institutions for maintaining dialogue and stability among nations, guaranteeing a space of inviolability, even in situations of political tension. This article examines an event that marked a turning point in the application of these principles: the assault on the Mexican Embassy in Ecuador. The main objective of this study is to analyze the legal implications of this event in the field of international law and criminal law. The research is based on a qualitative methodology based on the documentary analysis of secondary sources, including official documents, academic articles and news. The main findings reveal that the assault violated fundamental principles of international law, such as the inviolability of diplomatic missions and the right to asylum. In addition, potential criminal offenses were identified, such as disproportionate use of force and arbitrary detention. The study concludes that this incident represents a serious setback in the respect for international law and human rights, undermining the stability of diplomatic relations. It therefore emphasizes the need for States to strengthen mechanisms to ensure compliance with international norms and to harmonize their domestic legislation with their global obligations.
