VULNERABILIDAD DEL DERECHO A LA DEFENSA DENTRO DEL PROCESO INMEDIATO DE FLAGRANCIA: APLICABILIDAD DEL PLAZO RAZONABLE

Abstract

Resumen El presente artículo tiene como objetivo analizar la vulnerabilidad del derecho a la defensa dentro del proceso inmediato de flagrancia y la aplicabilidad del plazo razonable en el Perú. Método, se orientó por el análisis de diversas fuentes confiables como artículos, tesis y jurisprudencia; desde un enfoque cualitativo, con una antigüedad de 5 años, organizados dentro de la directriz prisma. Conclusión, el proceso inmediato en flagrancia, busca simplificar los procedimientos procesales, lo que conlleva a la transgresión de derechos fundamentales como la debida defensa y el plazo razonable, en merito a los tiempos limitados el abogado del acusado, no estudia la acusación de forma adecuada para ejercer la contradicción y aportar pruebas; siendo que la obligatoriedad de la norma en contar con una defensa, no implica que la misma sea eficaz.

Abstract The article aims to analyze the vulnerability of the right to defense within the immediate flagrante delicto process and the applicability of the reasonable period of time in Peru. Method, it was guided by the analysis of various reliable sources such as articles, theses and jurisprudence; from a qualitative approach, all with a maximum seniority of 5 years, within the prism guideline. Conclusion, the immediate process in flagrante delicto seeks to simplify procedural procedures, which leads to the transgression of fundamental rights such as due defense and reasonable time, the lawyer's short time does not have enough space to study the accusation, exercise the contradiction and provide evidence; being that the obligation of the norm to have a defense does not imply that it is effective.
